Terms of Service

These Terms of Service govern access to and use of the EvalProf platform at evalprof.com. By creating an account or using the platform, you accept these Terms without reservation. The French version of these Terms is the legally binding version.

1. Purpose and Definitions

These Terms define the conditions under which EvalProf makes its educational management and assessment platform available to users.

  • "EvalProf" or "we" means Francis Munabeno, sole trader, publisher of the platform.
  • "Platform" means all services accessible at evalprof.com.
  • "User" means any individual with an account on the platform.
  • "User Content" means any file, data or information uploaded by the user to the platform.
  • "Institution" means any legal entity (school, college, university, training organisation) subscribing on behalf of an entity.

2. Access to the Platform

Access to the platform is reserved for adults or, for minors, under the responsibility of their parents or legal guardians.

EvalProf reserves the right to deny access to any user who fails to comply with these Terms, without notice or compensation.

3. Account Creation and Management

Users agree to provide accurate information at registration and keep it up to date. Users are responsible for the confidentiality of their credentials and all activity carried out from their account.

4. Acceptable Use

Users agree to use the platform lawfully and for legitimate educational purposes. The following are prohibited:

  • Any fraudulent, abusive or unlawful use.
  • Attempts to gain unauthorized access to other users' data.
  • Uploading illegal, defamatory or infringing content.
  • Using bots, scrapers or automated tools without prior written authorization.
  • Reselling or providing platform access to unauthorized third parties.

5. User Content and Intellectual Property

Users retain ownership of their content. They grant EvalProf a non-exclusive license limited to providing the service.

EvalProf owns all elements of the platform (code, design, algorithms, trademarks). Reproduction is prohibited without written authorization.

6. Availability and Maintenance

EvalProf strives to maintain 24/7 platform availability. Interruptions for maintenance, updates or force majeure may occur. EvalProf shall not be liable for service interruptions.

7. Limitation of Liability

EvalProf's liability is limited to an obligation of means. EvalProf shall not be liable for indirect damages. In any event, liability is capped at amounts paid by the user in the 12 months preceding the claim.

8. Termination

Users may terminate their account at any time from their account settings. The account is deactivated immediately and all associated data is permanently deleted within 24 hours, except where legal retention obligations apply. EvalProf may terminate an account without notice for serious violations of these Terms, with a pro-rata refund for paid subscriptions.

9. Professional Users (B2B — Institutions)

If you subscribe on behalf of a school or any other professional entity, the following provisions apply in addition to or in replacement of the corresponding clauses:

  • The 14-day right of withdrawal does not apply to purchases made by professionals in the course of their business.
  • Statutory warranties are excluded in business-to-business relationships to the extent permitted by law.
  • EvalProf's limitation of liability applies in full against institutional clients.
  • A specific contract and/or Data Processing Agreement (DPA) will be signed before any processing of student data.
  • The exclusive jurisdiction of Paris courts applies to any dispute between EvalProf and an institution.

10. Changes to Terms

EvalProf may modify these Terms at any time. Users will be notified by email at least 15 days before any material change takes effect. Continued use after that date constitutes acceptance.

11. Governing Law and Jurisdiction

These Terms are governed by French law, excluding the Vienna Convention on the International Sale of Goods (CISG).

B2C users residing in the European Union: under Regulation (EU) No 1215/2012 (Brussels I bis), consumers may bring proceedings before the courts of their place of habitual residence. Otherwise, the courts of Paris have jurisdiction.

B2C users residing outside the EU: the courts of Paris (France) have exclusive jurisdiction.

B2B users (institutions): the courts of Paris have exclusive jurisdiction, including in cases of multiple defendants or third-party proceedings.

Mediation (EU consumers): consumers may use an approved mediator free of charge before bringing court proceedings.

12. Governing Language

These Terms are written in French, English and Spanish. In the event of any contradiction or ambiguity between versions, the French version shall prevail and be the sole authoritative text, subject to any mandatory provisions applicable in the user's country of residence.
